By accessing or using the Elite Remote Agent platform ("ERA," "Service," "Platform") at eliteremoteagent.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the platform including clients (businesses and individuals who hire VAs) and virtual assistants (individuals who apply to and work through the platform).
ERA reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
Elite Remote Agent is a subscription-based marketplace platform that connects business owners and real estate professionals ("Clients") with pre-screened virtual assistants ("VAs"). ERA provides:
ERA is a platform, not an employer. VAs are independent contractors, not employees of ERA. ERA does not supervise, direct, or control the work performed by VAs for clients. The working relationship and all employment-related decisions are solely between the client and the VA.
To use ERA, you must create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify ERA immediately at hello@eliteremoteagent.com if you suspect any unauthorized use of your account. ERA is not liable for any loss resulting from unauthorized account access that occurs through no fault of ERA.
Each user may maintain only one active account. Creating multiple accounts to circumvent bans or restrictions is prohibited and will result in permanent removal from the platform.
Upon subscribing, clients receive access to the ERA platform according to their chosen plan. Access is granted for the duration of the active subscription and terminates upon cancellation or non-payment.
When you hire a VA through ERA, you are entering into a direct working relationship with that VA as an independent contractor. You are responsible for:

By subscribing, you represent that all information provided to ERA is accurate and that your use of the platform complies with all applicable laws and regulations in your jurisdiction.
Applying to ERA does not guarantee acceptance. ERA reserves the right to reject any application or remove any VA from the platform at its sole discretion, with or without cause.
By applying and maintaining a profile on ERA, VAs represent that:
VAs agree not to solicit ERA clients for work outside the ERA platform for a period of 12 months from the date of first contact with that client through ERA. This restriction applies to direct solicitation. It does not prevent VAs from accepting work independently if the client initiates contact outside the platform after the 12-month period.
VAs must keep their profile information current. Misrepresentation of skills, experience, or identity is grounds for immediate removal from the platform.
ERA charges no fees to VAs. VAs receive 100% of what their clients pay them directly. ERA's revenue comes solely from client subscriptions.
ERA subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize ERA to charge your payment method on a recurring basis until you cancel.
All payments are processed through Stripe. By using ERA, you agree to Stripe's terms of service. ERA does not store credit card numbers on its servers.
ERA reserves the right to change subscription prices with at least 30 days' notice. Price changes take effect at your next billing cycle. Continued use after price changes take effect constitutes acceptance of the new pricing.
You may cancel your subscription at any time from your account billing page. Cancellation takes effect at the end of your current billing period. ERA does not provide prorated refunds for partial months except where required by law.
ERA does not provide refunds for subscription fees except in cases of billing errors or as required by applicable law. If you believe you have been billed in error, contact us within 30 days at hello@eliteremoteagent.com.
If a payment fails, ERA will attempt to retry the charge. If payment cannot be collected after reasonable attempts, your account may be suspended until payment is resolved. You will be notified by email of any payment failures.
You agree not to use ERA to:
Violations may result in immediate account suspension or termination without refund.
The ERA platform, including its design, text, graphics, logos, training content, and software, is owned by or licensed to Elite Remote Agent and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from ERA content without express written permission.
By uploading content to ERA (including VA profiles, voice recordings, resumes, training materials, and SOPs), you grant ERA a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for the purpose of operating the platform. You retain ownership of your content.
Any feedback, suggestions, or ideas you provide to ERA may be used by ERA without compensation or attribution to you.
ERA does not guarantee that clients will find suitable VAs or that VAs will be hired. ERA is a marketplace — outcomes depend on the parties involved.
ERA does not guarantee the performance, quality, or reliability of any VA. While ERA screens VAs thoroughly, ERA is not responsible for the work product, actions, or conduct of VAs in their relationships with clients.
THE ERA PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO ERA IN THE 3 MONTHS PRECEDING THE CLAIM. ERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold ERA harmless from any claims, losses, or damages (including legal fees) arising from your use of the platform, your violation of these Terms, or your relationship with any VA or client.
You may terminate your ERA account at any time by cancelling your subscription and deleting your account from your account settings. Termination does not entitle you to a refund of any prepaid fees except as required by law.
ERA reserves the right to suspend or terminate your account at any time for:
In cases of serious violations, termination may be immediate without notice. In other cases, ERA will provide reasonable notice where practical.
Upon termination, your access to the platform ceases immediately. ERA may retain certain information as required by law or for legitimate business purposes as outlined in our Privacy Policy.
Before filing any formal dispute, you agree to contact ERA at hello@eliteremoteagent.com and attempt to resolve the issue informally. ERA will make good-faith efforts to resolve any dispute within 30 days.
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms that cannot be resolved informally shall be resolved through binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
You agree to resolve disputes with ERA on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against ERA.
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
ERA may update these Terms at any time. When we make material changes, we will notify you by email and by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of ERA after the effective date of updated Terms constitutes your acceptance of the changes.
If you do not agree to updated Terms, you must cancel your subscription before the effective date of the changes.
