Please read these terms carefully before subscribing to or using the Elite Remote Agent platform.
By accessing or using the Elite Remote Agent platform, website located at eliteremoteagent.com, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you ("Client," "User," or "you") and Elite Remote Agent, operated by James Burbank ("Company," "we," "us," or "our"), a business based in Phoenix, Arizona.
These Terms apply to all visitors, registered users, clients, and virtual assistants who access or use the Platform in any capacity.
Elite Remote Agent is a subscription-based platform that connects business owners and professionals with pre-screened, trained virtual assistants ("VAs"). Our services include:
We are a platform and intermediary, not an employer. Elite Remote Agent does not employ the VAs listed on our platform. The Company facilitates connections between clients and independent contractors. Once hired, the VA works directly for and with you under a separate agreement.
Important: All payments for VA services (hourly compensation, project fees, etc.) are paid directly from the client to the VA. The Elite Remote Agent subscription fee covers platform access only — not VA labor costs.
To use the Platform, you must be at least 18 years old and have the legal capacity to enter into contracts. By using the Platform, you represent and warrant that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at james@soldbyburbank.com if you suspect any unauthorized access to your account.
You agree to provide accurate, complete, and current information when creating an account. The Company reserves the right to suspend or terminate accounts that contain false or misleading information.
The Platform is offered on a subscription basis. Current plans and pricing are published at eliteremoteagent.com/checkout.html and are subject to change.
Starter Plan: Requires a one-time setup fee of $149 at enrollment. Monthly platform access is billed at $49/month beginning with your first billing cycle following setup. The setup fee is non-refundable after your account has been created and you have received access to the platform.
Growth and Elite Plans: Billed monthly or annually as selected at checkout. Annual subscriptions are billed in full at the start of each annual term.
All billing is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan until you cancel. You are responsible for keeping your payment information current.
We stand behind our platform and want every client to feel confident in their subscription. Our refund policy is as follows:
Setup Fees: The one-time $149 Starter setup fee is non-refundable once your account has been activated and you have been granted access to the platform.
Monthly Subscriptions: If you are not satisfied within the first 7 days of your initial monthly subscription, contact us and we will review your case and issue a refund of the first month's platform fee at our discretion. After 7 days, monthly subscription fees are non-refundable.
Annual Subscriptions: Annual subscriptions are eligible for a prorated refund within the first 30 days if you have not placed a VA through the platform. After 30 days or after a successful VA placement, annual fees are non-refundable.
VA Replacement Guarantee: If a VA you hire through the platform does not work out for any reason, we will replace them at no additional cost, on any plan, with no limit on replacements. This is not a refund — it is a replacement guarantee.

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You agree not to:
The Company reserves the right to suspend or terminate any account that violates these conduct standards without prior notice.
Elite Remote Agent pre-screens, interviews, and vets all VAs listed on the platform before approving their profiles. However, we make no guarantee regarding the performance of any individual VA once hired.
Independent Contractor Relationship: VAs on the Platform are independent contractors, not employees of Elite Remote Agent or of the client. You are solely responsible for managing, directing, and compensating any VA you hire through the Platform in compliance with applicable laws.
Client Responsibilities: You are responsible for:
Non-Solicitation: During your active subscription and for 12 months following cancellation, you agree not to directly hire, solicit, or recruit any VA you were introduced to through the Platform outside of the Platform without our written consent. Violation of this provision may result in a non-solicitation fee of $2,500 per VA.
All content on the Platform — including but not limited to text, graphics, logos, training materials, the Elite Remote Agent name and branding, and software — is the exclusive property of Elite Remote Agent or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal or internal business purposes during your active subscription. This license does not permit you to copy, reproduce, distribute, or create derivative works from any Platform content without our express written consent.
Content you upload to the Platform (SOPs, task descriptions, communications) remains your property. By uploading it, you grant us a limited license to store and display it as necessary to provide the service.
AS-IS BASIS: The Platform is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific business results from using a VA or our platform.
Limitation of Liability: To the fullest extent permitted by applicable law, Elite Remote Agent and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any cause of action related to these Terms or the Platform shall not exceed the greater of (a) the total subscription fees paid by you to the Company in the 3 months preceding the event giving rise to the claim, or (b) $100.
By You: You may cancel your subscription at any time through your account dashboard or by emailing james@soldbyburbank.com. Cancellation takes effect at the end of your current billing period. You retain access to the Platform until that date.
By Us: We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion. In cases of termination for cause, no refund will be issued for any remaining subscription period.
Upon termination, your right to access the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be submitted to binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
By agreeing to these Terms, you waive any right to a jury trial and agree that disputes will be resolved on an individual basis only — not as part of any class or representative action.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify active subscribers by email.
Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Platform and cancel your subscription.
